We reserve the right to refuse service to anyone for any valid commercial reason at any time. We offer solid-colour headwear directly to our customers. We make every effort to display the colours and images of our products as accurately as possible; however, minor variations may occur depending on your monitor’s display settings.

4. Ordering and Payment Processing

By placing an order, you are offering to purchase a product subject to these Terms. All orders are subject to availability and confirmation of the order price.

We accept various standard payment methods. Payment processing is conducted subject to standard industry protocols. Once you place an order, you will receive an acknowledgement email confirming receipt of your order; this email is an acknowledgement and does not constitute acceptance of your order until the goods are dispatched.

5. Delivery and Shipping

Orders are dispatched from our warehouse located at 80 Lansford Crescent, Avondale, Auckland 0600, New Zealand. We partner with established carriers including DHL, FedEx, and UPS (Priority services) to fulfil our orders to Europe.

  • Processing and Dispatch: Order processing and preparation for dispatch require 2 to 3 working days..
  • Delivery Timeframes: Following dispatch, standard transit to Europe requires 7 to 12 working days.
  • Tracking Details: At key logistical nodes (order dispatch, arrival at carrier facilities, and local delivery routes), we will automatically send tracking updates to the email address provided at checkout so you can monitor your order’s progress.
  • Delayed Parcels: Should your order exceed the stated processing and delivery timeframes, we will initiate an immediate investigation with the relevant carrier. Depending on the findings, we will arrange for a full refund or dispatch a replacement shipment to you.

6. Transfer of Risk

In strict accordance with the European Consumer Rights Directive, the risk of loss or damage to the goods passes to you exclusively when you, or a third party indicated by you (other than the carrier), have acquired physical possession of the goods.

7. Right of Withdrawal (European Customers)

If you reside within the European Union or European Economic Area, you possess a statutory Right of Withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

8. Damaged or Flawed Items

If you receive an item that is damaged, flawed, or otherwise non-conformant upon delivery, you are entitled to a remedy. Please contact our support team at hat@monotonecap.com within a reasonable timeframe after delivery.

When contacting us, please provide clear photographic evidence of the issue. Upon reviewing the photographs, we will process a full refund or send a replacement item. You are not required to return the physically damaged item to us to process this resolution.

9. Limitation of Liability

Hatworx Ltd shall be liable for damages resulting from injury to life, body, or health, or from intentional or grossly negligent breaches of duty by us or our legal representatives. In all other respects, our liability is limited to the foreseeable, typical damage at the time the contract was concluded, provided the damage was caused by a slightly negligent breach of a material contractual obligation.

10. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand. However, if you are a consumer residing in the European Union, this choice of law will not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law of the jurisdiction where you have your habitual residence.
